ห้างหุ้นส่วนจำกัดเซ้าเทิร์นมีเดีย ( ” เรา ” หรือ ” ห้างหุ้นส่วนฯ ” ) ตระหนักและให้ความสำคัญอย่างยิ่งต่อการคุ้มครองข้อมูลส่วนบุคคลของท่านตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (“PDPA”) และกฎหมายที่เกี่ยวข้อง รวมถึงการปฏิบัติตามหลักการคุ้มครองข้อมูลส่วนบุคคลระดับสากล เช่น กฎระเบียบว่าด้วยการคุ้มครองข้อมูลส่วนบุคคลของสหภาพยุโรป (General Data Protection Regulation: GDPR) ในกรณีที่มีการประมวลผลข้อมูลส่วนบุคคลของบุคคลที่อยู่ในเขตเศรษฐกิจยุโรป (European Economic Area: EEA) หรือสหราชอาณาจักร (UK) นโยบายความเป็นส่วนตัวฉบับนี้จัดทำขึ้นเพื่อชี้แจงถึงวิธีการที่เราเก็บรวบรวม ใช้ เปิดเผย และ/หรือโอนข้อมูลส่วนบุคคลของท่าน รวมถึงสิทธิของเจ้าของข้อมูลส่วนบุคคล
Southern Media Limited Partnership ( ” we ,” ” our ,” or ” The Partnership ” ) recognizes the importance of protecting your personal data in accordance with the Personal Data Protection Act B.E. 2562 (PDPA) and other relevant laws, including international standards such as the European Union’s General Data Protection Regulation (GDPR), where applicable.
This Privacy Policy explains how we collect, use, disclose, and/or transfer your personal data, as well as your rights as a data subject.

- ” ข้อมูลส่วนบุคคลอ่อนไหว ” หมายถึง ข้อมูลส่วนบุคคลตามที่กฎหมายกำหนด ซึ่งต้องได้รับความคุ้มครองเป็นพิเศษ เช่น เชื้อชาติ เผ่าพันธุ์ ความคิดเห็นทางการเมือง ความเชื่อในลัทธิ ศาสนาหรือปรัชญา พฤติกรรมทางเพศ ประวัติอาชญากรรม ข้อมูลสุขภาพ ความพิการ ข้อมูลสหภาพแรงงาน ข้อมูลพันธุกรรม ข้อมูลชีวภาพ หรือข้อมูลอื่นใดที่อาจกระทบต่อเจ้าของข้อมูลส่วนบุคคลในทำนองเดียวกัน
- ” ประมวลผลข้อมูลส่วนบุคคล ” หมายถึง การเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล
- Personal Data: Information that identifies an individual, either directly or indirectly, excluding the data of deceased persons.
- Sensitive Personal Data: Data requiring special protection under the law, such as race, ethnicity, political opinions, religious or philosophical beliefs, sexual behavior, criminal records, health data, disability information, trade union membership, genetic or biometric data, or any similar information that may affect the data subject.
- Processing of Personal Data: Refers to the collection, use, or disclosure of personal data.
2. ขอบเขตการใช้นโยบาย (Scope of Policy)
นโยบายนี้ครอบคลุมถึงข้อมูลส่วนบุคคลที่เราเก็บรวบรวมผ่านช่องทางต่างๆ ดังต่อไปนี้:

- Contact Information: Mailing address, email address, telephone number, social media accounts
- Job Application Data: Educational background, work experience, skills, expected salary, photos, and other supporting documents
- Technical Data: IP address, login details, browser type/version, time zone settings, browser plugins, operating system, and platform
- Usage Data: Website behavior, page visits, duration of visits, navigation patterns, frequency of visits, cookies
- Location Data: Geographic location (if permission is granted)
- Other Voluntary Information provided during your communication with us
We will collect sensitive personal data only when we have obtained your explicit consent or as otherwise permitted by law.

5. ฐานทางกฎหมายในการประมวลผลข้อมูลส่วนบุคคล (Legal Bases for Processing)
เราจะประมวลผลข้อมูลส่วนบุคคลของท่านภายใต้ฐานทางกฎหมายดังต่อไปนี้ ซึ่งสอดคล้องกับหลักการของ พระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล (PDPA) และ กฎระเบียบว่าด้วยการคุ้มครองข้อมูลส่วนบุคคลของสหภาพยุโรป (GDPR) (หากมีผลบังคับใช้):
- ความยินยอม (Consent): ในกรณีที่เราต้องการประมวลผลข้อมูลส่วนบุคคลของท่านเพื่อวัตถุประสงค์ที่กฎหมายกำหนดให้ต้องได้รับความยินยอม เช่น การตลาดทางตรง หรือการเก็บรวบรวมข้อมูลส่วนบุคคลอ่อนไหว
- การปฏิบัติตามสัญญา (Contractual Obligation): เพื่อปฏิบัติตามสัญญาที่ท่านเป็นคู่สัญญา หรือเพื่อใช้ในการดำเนินการตามคำขอของท่านก่อนเข้าทำสัญญา
- การปฏิบัติตามกฎหมาย (Legal Obligation): เพื่อปฏิบัติตามกฎหมายที่เกี่ยวข้องที่ห้างหุ้นส่วนฯ มีหน้าที่ต้องปฏิบัติตาม
- ประโยชน์อันชอบด้วยกฎหมาย (Legitimate Interest): เพื่อประโยชน์อันชอบด้วยกฎหมายของห้างหุ้นส่วนฯ หรือของบุคคลภายนอก เว้นแต่ประโยชน์ดังกล่าวมีความสำคัญน้อยกว่าสิทธิขั้นพื้นฐานในข้อมูลส่วนบุคคลของท่าน
- การป้องกันหรือระงับอันตรายต่อชีวิต ร่างกาย หรือสุขภาพ (Vital Interest): ในกรณีที่มีความจำเป็นเร่งด่วนเพื่อป้องกันหรือระงับอันตรายต่อชีวิต ร่างกาย หรือสุขภาพของบุคคล
- การปฏิบัติภารกิจของรัฐ (Public Task): ในกรณีที่มีความจำเป็นเพื่อการปฏิบัติภารกิจเพื่อประโยชน์สาธารณะ หรือการใช้อำนาจรัฐที่ได้มอบให้แก่ห้างหุ้นส่วนฯ
We process your personal data under the following legal bases in accordance with the Personal Data Protection Act (PDPA) and, where applicable, the General Data Protection Regulation (GDPR):
• Consent When your explicit consent is required by law to process your personal data, such as for direct marketing purposes or the collection of sensitive personal data, we will ask for and rely on your consent before proceeding.
• Contractual Obligation We process your data as necessary to fulfill a contract to which you are a party or to take steps at your request before entering into a contract.
• Legal Obligation We process your data when it is necessary for compliance with applicable legal obligations to which The Partnership is subject.
• Legitimate Interest We may process your data based on our legitimate interests or those of a third party, provided such interests do not override your fundamental rights and freedoms related to your personal data.
• Vital Interest In emergency situations where it is necessary to protect an individual’s life, physical well-being, or health, we may process personal data to the extent required.
• Public Task In certain cases, we may process your data when necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in The Partnership.
6. การเปิดเผยข้อมูลส่วนบุคคล (Disclosure of Personal Data)
เราอาจเปิดเผยข้อมูลส่วนบุคคลของท่านให้แก่บุคคลภายนอกดังต่อไปนี้:

We may disclose your personal data to the following external parties:

We ensure that all third parties are contractually obligated to maintain the confidentiality and security of your personal data and not to use it beyond the scope specified.

ในบางกรณี เราอาจมีความจำเป็นต้องโอนข้อมูลส่วนบุคคลของท่านไปยังผู้ให้บริการหรือคู่ค้าของเราที่ตั้งอยู่ในต่างประเทศ ซึ่งอาจมีมาตรฐานการคุ้มครองข้อมูลส่วนบุคคลที่แตกต่างจากประเทศไทย หรือจากเขตเศรษฐกิจยุโรป (European Economic Area: EEA) หรือสหราชอาณาจักร (UK) หากท่านอยู่ในเขตพื้นที่ดังกล่าว
เราจะดำเนินการตามมาตรการที่เหมาะสมเพื่อให้แน่ใจว่าข้อมูลส่วนบุคคลของท่านได้รับการคุ้มครองในระดับที่เพียงพอตามที่กฎหมายกำหนด โดยอาจรวมถึงแต่ไม่จำกัดเพียง:
- การโอนข้อมูลไปยังประเทศที่คณะกรรมการคุ้มครองข้อมูลส่วนบุคคลของไทย หรือคณะกรรมาธิการยุโรป (European Commission) ได้ประกาศรับรองว่ามีมาตรฐานการคุ้มครองข้อมูลส่วนบุคคลที่เพียงพอ (Adequacy Decision)
- การจัดให้มีข้อสัญญามาตรฐาน (Standard Contractual Clauses: SCCs) ที่ออกโดยคณะกรรมาธิการยุโรป หรือข้อตกลงการโอนข้อมูลอื่นใดที่ได้รับการรับรอง
- การใช้กฎระเบียบองค์กรที่มีผลผูกพัน (Binding Corporate Rules: BCRs) ในกรณีที่เป็นการโอนข้อมูลภายในกลุ่มบริษัท
- การได้รับความยินยอมโดยชัดแจ้งจากท่าน หลังจากที่ท่านได้รับแจ้งถึงความเสี่ยงที่อาจเกิดขึ้นจากการโอนข้อมูลโดยไม่มีมาตรการคุ้มครองที่เพียงพอ
- การโอนข้อมูลเป็นไปเพื่อการปฏิบัติตามสัญญาที่ท่านเป็นคู่สัญญา หรือเพื่อการดำเนินการตามคำขอของท่านก่อนเข้าทำสัญญา
- การโอนข้อมูลเป็นไปเพื่อการใช้สิทธิเรียกร้องตามกฎหมาย
In some instances, we may need to transfer your personal data to our service providers or partners located in foreign jurisdictions that may have data protection standards differing from those of Thailand or the EEA/UK.
In such cases, we will implement appropriate safeguards to ensure your data is adequately protected, including but not limited to:
- Transfers to countries recognized by the Thai Data Protection Committee or European Commission as having adequate data protection standards.
- Standard Contractual Clauses (SCCs) issued by the European Commission or other approved transfer mechanisms.
- Binding Corporate Rules (BCRs) for intra-group transfers.
- Your explicit consent after being informed of potential risks due to the lack of adequate protection.
- Transfers necessary for the performance of a contract to which you are a party.
- Transfers required for the establishment, exercise, or defense of legal claims.
8. ระยะเวลาการเก็บรักษาข้อมูลส่วนบุคคล (Data Retention Period)
เราจะเก็บรักษาข้อมูลส่วนบุคคลของท่านตราบเท่าที่จำเป็นเพื่อวัตถุประสงค์ที่ระบุไว้ในนโยบายนี้ หรือตามที่กฎหมายกำหนด หรือจนกว่าท่านจะใช้สิทธิขอให้ลบหรือทำลายข้อมูล
โดยทั่วไป :
- ข้อมูลการติดต่อ: จะถูกเก็บรักษาไว้ตลอดระยะเวลาที่ท่านยังคงเป็นลูกค้าหรือผู้ติดต่อของเรา และอาจเก็บต่อไปอีกระยะหนึ่งตามความจำเป็นในการปฏิบัติตามกฎหมาย หรือเพื่อประโยชน์ในการดำเนินคดี
- ข้อมูลการสมัครงาน: จะถูกเก็บรักษาไว้เป็นระยะเวลาไม่เกิน 1 ปี นับจากวันที่ท่านส่งใบสมัคร หากท่านไม่ได้รับการคัดเลือก เว้นแต่จะได้รับความยินยอมจากท่านให้เก็บรักษาไว้เพื่อพิจารณาตำแหน่งอื่นๆ ในอนาคต
- ข้อมูลการใช้งานเว็บไซต์ (คุกกี้): จะถูกเก็บรักษาตามอายุของคุกกี้แต่ละประเภท หรือตามที่กำหนดไว้ในนโยบายคุกกี้ของเรา
- ข้อมูลอื่นๆ: จะถูกเก็บรักษาตราบเท่าที่จำเป็นตามวัตถุประสงค์ที่เก็บรวบรวม และตามระยะเวลาที่กฎหมายกำหนด
เมื่อหมดความจำเป็นในการเก็บรักษา หรือเมื่อพ้นระยะเวลาที่กำหนด เราจะดำเนินการลบ ทำลาย หรือทำให้ข้อมูลส่วนบุคคลของท่านเป็นข้อมูลที่ไม่สามารถระบุตัวบุคคลได้ (Anonymization) อย่างปลอดภัย
We will retain your personal data only as long as necessary for the purposes stated in this policy, or as required by law, or until you request its deletion or destruction.
Examples include:
- Contact Information: Retained as long as you remain a client or contact, and for a legally permissible period thereafter.
- Job Applications: Retained for up to 1 year from the date of submission if the applicant is not selected, unless explicit consent is given to retain for future opportunities.
- Website Usage Data (Cookies): Retained based on the cookie’s lifespan, as detailed in our Cookies Policy.
- Other Data: Retained for as long as necessary to fulfill its intended purpose and for the duration required by law.
Once the retention period expires or the data is no longer necessary, we will securely delete, destroy, or anonymize your personal data.
9. มาตรการรักษาความปลอดภัยของข้อมูลส่วนบุคคล (Security Measures for Personal Data)
